What is Trespass
A person commits a trespass offence if they unlawfully enter, or remain in, a dwelling or a yard for a dwelling. The same offence applies for people who unlawfully enter, or remain in, business premises.
The important point is that the entry must be unlawful for it to be an offence, otherwise people such as couriers could be charged with trespass every time they tried to deliver parcels.
Trespass Penalties
The usual penalty for a trespass is a fine of up to about $2,000 however there is the possibility of jail for up to 1 year.
Importantly, a criminal conviction can also be recorded on a person’s criminal history. This conviction could prevent a person from travelling overseas or getting certain types of jobs.
